The fund is legally defined by law (P&CE code article R20-44-6,7,11,14,1811 and décret n°2005-1168)
The fund is managed by ANFR.
The French finance ministry provided ANFR with 55 Million euros to start the fund.
The money is then used to fund the required changes and bills are provided to ANFR. Every six months the incomer refunds ANFR on the expenses based on the amount of spectrum he owns and actual amount spend by ANFR. In the case where the incomer is not known (i.e auction has not taken place yet…) the ANFR will request the refund once the incomer is selected. In the meantime the expenditure is taken from the ANFR funds.
A “convention” / a contract is produced between the three parties involved (existing user, New user and ANFR). For the case of Mobile services, ARCEP represents their interest and for Broadcasting CSA. This document sets out the modality for the move, financial implications and how ANFR will monitor and control this process.
ANFR must:
- Ensure the process of migration is progressing according to plan
- Validate the cost of migration by review of all the bills.
- Evaluate the cost of the refarming
- Ensures the deadlines are met
